No limitations. On property purchases
Andermatt Swiss Alps apartments and penthouses are not affected by the Second Homes Act (Lex Weber). Moreover, Andermatt is the only Alpine destination in Switzerland that is completely exempt from Lex Koller . This means that foreign investors can acquire properties – and also resell them – without any limitations and make this unique village their home.
The law restricts the construction of second homes to 20 percent of the number of residences in a municipality. None of the properties sold by Andermatt Swiss Alps are covered by the scope of the law, since they were approved as part of a special land-use plan back in 2009.
The ordinance, which entered into force on 1 January 2013, states in Article 8 (1): “Building permits for new second homes based on a project-related special land-use plan may be issued in accordance with earlier legislation if the land-use plan a) received approval which took legal effect before 11 March 2012 and b) stipulates the essential elements of the building permit relating to location, layout, size and design of the buildings and installations as well as nature and extent of their use.”
An identical provision was included in Article 26 (1) of the Second Homes Act, which entered into force on 1 January 2016 and thus replaced the ordinance.
Lex Koller is the informal name of the Swiss Federal Law of 16 December 1983 on the acquisition of real estate by persons abroad (
Bundesgesetz über den Erwerb von Grundstücken durch Personen im Ausland , BewG), which regulates the acquisition of real estate by natural persons and legal entities abroad. As a rule, persons abroad must apply for a permit from the responsible cantonal and federal authorities before they will be allowed to acquire real estate in Switzerland.By decree of 22 September 2006, the Federal Council (federal government) exempted the village part Andermatt Reuss from the “Lex Koller” permit requirement and on 21 December 2007 reaffirmed this decision by approving a more extensive petition. Regardless of whether or not international buyers are domiciled in Switzerland, they may acquire apartments and houses in the holiday village of Andermatt Reuss without a permit and without limitation and resell them without any minimum holding periods.
The exemption from “Lex Koller” is currently set to expire in 2040.
Low taxes.Advantageous inheritance law
Uri’s maximum income tax rate is the second lowest in Switzerland and only about half as high as the tax rates in the UK, Germany, France and Italy, which puts Andermatt among the destinations where tax treatment is the most advantageous. In addition, Uri does not impose any inheritance or gift taxes – the canton’s inheritance law is thus among the most liberal in the world.
Benefit from flat-rate taxation
Foreign nationals who relocate to the canton of Uri and make it their principal residence can obtain a residency permit via flat-rate taxation , which is an advantageous taxation system for wealthy individuals. In addition to the tax advantages, new residents of Uri have access to Switzerland’s excellent educational and health systems.
